Preparing your probate application

Applying for Probate

Applying for probate involves requesting permission from a court to handle a person’s finances and affairs after they have passed away. The process is a legal requirement for anyone who wants to administer the instructions in a will or distribute a person’s wealth or assets if they died in testate (did not have a will).

A will usually nominates a specific person to act as an executor. If this is the case, they will need to apply for probate. However, if there is no will or executor, a close family member or friend can apply to handle the estate.
