1. Private Wealth Mortgages Ltd User Terms

1.1 In accordance with the following user terms , the Independent Mortgage Adviser listed at the top of these User Terms grants to you as an authorised user ('you') of this site ('Web Site') certain rights (as set out below) and in return you agree to perform certain obligations.

1.2 Private Wealth Mortgages is regulated by the Financial Conduct Authority (FCA) If you wish to verify the authorisation of Private Wealth Mortgages you may do so by conducting a free on-line search of the Financial Services Register."

1.3 Please read these User Terms carefully. They are a legal document and, by your continued use of the Web Site, you agree to be bound by these User Terms.

1.4 If you do not agree with these User Terms and do not wish to be bound by them, please exit this Web Site and do not use the Web Site in the future.

1.5 Any goods and services ("Merchandise") offered for sale by companies other than Private Wealth Mortgages Ltd ("Third Party Content Providers") via third party web sites linked to this Web Site are subject to separate terms and conditions between you and the applicable Third Party Content Provider. You acknowledge that the applicable Third Party Content Provider is solely responsible for the fulfilment of orders for any merchandise and for its quality, suitability, and fitness for purpose. Any disputes or questions relating to the Merchandise must be directed to the Third Party Content Provider in question and you acknowledge that Private Wealth Mortgages shall have no responsibility, obligations or liability in relation to the Merchandise.

2. Licence to Use Material on Web Site

2.1 Private Wealth Mortgages grants to you a personal, non-exclusive, non-transferable, royalty-free licence to use all the material on the Web Site (including but not limited to: software, documentation, text, pictures, sounds, graphics, articles, video or audio clips, and advertising material) ('Private Wealth Mortgages Material') on the basis set out in Clause 2.2.

2.2.1 remove any notices relating to the ownership of copyright or other intellectual property rights in the Material;

2.2.2 modify, translate, reverse engineer, reproduce, decompile, disassemble (except as expressly permitted by law) or create derivative works of any of the Material;

2.2.3 rent, lease, sub-licence, loan, copy or give or transfer any rights in the Material in any form, to any person or entity without the prior written consent of Private Wealth Mortgages.

2.3 Any product, process or technology referred to in the Material may be subject to other intellectual property rights of Private Wealth Mortgages and are not made available hereunder.

3. Ownership of Intellectual Property Rights

3.1 Notwithstanding the limited rights granted to you in accordance with Clause 2, Private Wealth Mortgages or other third parties which licence such material to us, retain their ownership, title and interest in the intellectual property rights contained in the Material including but not limited to copyright, database rights, trade marks, patents, service marks, design rights (whether registerable or otherwise) know-how, trade or business names, domain names, goodwill associated with any of the foregoing and other similar rights or obligations whether registerable or not in any jurisdiction in the world.

3.2 You agree that any material (including any Intellectual Property Rights in such material), including but not limited to material which may be sent via any chat services, bulletin boards, competitions or articles submitted for publication or similar services offered via this Web Site ("Web Site Services") on the Web Site or in using any of the Web Site Services ("User Generated Content") may be retained as the property of Private Wealth Mortgages. We shall have no obligations with regard to the User Generated Content, or monitor the User Generated Content to ensure that it complies with applicable laws or regulations. You remain solely responsible for the User Generated Content in accordance with Clause 6.

3.3 Private Wealth Mortgages may have trademarks in its name. All other product names and company logos mentioned in the information, documents or other items provided or available on this Web Site may be the trademarks of their respective owners.

4. Duration of User Terms and Termination

4.1 These User Terms are binding upon you immediately. You accept them by your use of this Web Site, and they will remain in force until the earlier of the following:

4.1.1 you breach any of the terms of the licence granted to you in accordance with Clause 2;

4.1.2 Private Wealth Mortgages terminates these User Terms by notice to you at any time in accordance with Clause 9.2; or

4.1.3 you terminate these User Terms by notice to Private Wealth Mortgages at any time in accordance with Clause 9.1.

4.2 In the event that these User Terms are terminated for any of the reasons stated above, you agree to comply with the following obligations:

4.2.1 the licence granted to you in accordance with Clause 2 shall be terminated forthwith and you shall have no further rights to use the Material;

4.2.2 you must delete or destroy any of the Material stored by you in electronic or hard copy form as soon as reasonably practicable; and

4.2.3 you will have no further rights to access or use the Web Site or the Web Site Services.

5. Our Responsibilities

5.1 Private Wealth Mortgages undertakes to use commercially reasonable endeavours to prevent breaches of security of the Web Site.

5.2 Private Wealth Mortgages makes no representation or warranty that the Web Site or Web Site Services will be accessible, or useable by you or error free. Private Wealth Mortgages uses reasonable efforts to include accurate and up-to-date information on the Web Site. The information, documents or other items provided or available on this Web Site could include technical inaccuracies or typographical errors. Private Wealth Mortgages makes no warranties or representations as to its accuracy. Private Wealth Mortgages assumes no liability or responsibility for any errors or omissions in the content on the Web Site.

6.2.3 for any purposes connected to any business, including sending any unsolicited advertisements or promotional material.

6.3 You agree to indemnify Private Wealth Mortgages against any claims, costs, expenses or legal proceedings caused as a result of your use of the Web Site or Web Site Services in contravention of Clauses 6.1 and 6.2. Further, in these circumstances, Private Wealth Mortgages shall be entitled to treat the contravention as a material breach of these User Terms and terminate the User Terms and any access permission granted to you by Private Wealth Mortgages forthwith, without notice to you.

7. Consent to Use of Your Personal Information

For the purposes of the Date Protection Act 1998, you acknowledge that in the course of using this Web Site and the Web Site Services, certain personal information or data about you will be captured electronically or otherwise and transmitted to Private Wealth Mortgages. By accepting these User Terms, you expressly agree to transfer such personal information or data to Private Wealth Mortgages to use, store and process the personal information in accordance with the provisions set out in the Privacy Policy.

8. Disclaimers

8.1 You accept that it is reasonable that, to the maximum extent permitted by law, all representations, conditions, warranties and other terms whether implied by statute, common law, course of dealing or otherwise are excluded.

8.2 Nothing in these Terms of Use limits Private Wealth Mortgages liability to you for death or personal liability caused by our negligence.

8.3 Private Wealth Mortgages hereby disclaims any liability to any person for any kind of loss or damage including, but not limited to, any special, incidental, indirect or consequential loss or damages caused by errors or omissions in the information or other items provided or available herein, whether such errors or omissions result from negligence, accident or any other cause.

8.4 To the extent that Private Wealth Mortgages is deemed by a court of competent jurisdiction to have any liability to you in contract, tort (including negligence) or otherwise in relation to this Web Site or the Web Site Services, our entire liability shall be limited to £1,000 (one thousand pounds) for any one incident or series of related incidents and up to £5,000 (five thousand pounds) for all incidents in any period of 12 months.

The links will let you leave the Web Site and we are not responsible for any contents of any linked web site or any link contained in a linked web site. 9.2 Private Wealth Mortgages may send you notice by general notice on this Web Site, by e-mail to your e-mail address on record, or by post to the geographical address on record. Such notice will be effective if sent by e-mail or posted on the Web Site, 1 day from the date it was sent or posted on the Web Site. If sent by regular post, it will be effective 3 days after posting.

10. General

10.1 Private Wealth Mortgages reserves the right to add to or change the terms of these User Terms in its sole discretion without prior notice to you. All changes to the User Terms will be effective once posted on the Web Site. Private Wealth Mortgages will provide notice of the changes to the User Terms for a reasonable time after posting the amended User Terms on the Web Site. Your continued use of the Web Site or the Web Site Services following our posting of such changes will be regarded by us as acceptance of the amended User Terms. If you do not agree to be bound by the amended User Terms you should exit the Web Site and not access or use the Web Site in the future.

10.2 If any part of these User Terms are held by a court of competent jurisdiction to be unenforceable, the validity of the remainder of these User Terms will not be affected.

10.3 If Private Wealth Mortgages is unable to perform any obligation under these User Terms because of a matter beyond its reasonable control (including but not limited to); fire, flood, war, explosion, civil disorder, or other disasters or governmental laws or regulations imposed after the fact, or events beyond the reasonable control of Private Wealth Mortgages, we will have no liability for that failure to perform.

10.4 Any person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

Whose mortgage products do we offer?

At Private Wealth, we take pride in providing an exceptional service for our clients and you will benefit from years of experience within the mortgage industry. We use an extensive sourcing facility to ensure you are given advice from the whole of the mortgage market.

We are not limited in the range of mortgages we will consider for you.

Which service(s) will we provide you with?

We offer an ‘advised’ service.  This means we will provide advice and make a recommendation for you after we have assessed your specific needs and circumstances. Our client support team will do all they can to ensure your mortgage is guided to a successful completion and we will liaise with solicitors and agents on your behalf.


Reviewing your current protection needs and advising accordingly is part of our service. We do not charge a separate fee. If any insurance contracts are arranged we will be paid commission from the insurance company when the contract starts.

We offer products from a range of insurers for all non-investment insurance products, including building & contents, mortgage payment protection and life assurance.

We will advise and make a recommendation for you after we have assessed your needs for all non-investment insurance products.

Specialist Services

We can refer to you other professional organisations, if required, such as conveyancing, will writing specialists, tax specialists, independent financial advisers and accountants.

Our Service - Fees

Our initial consultation service is at the expense of Private Wealth Mortgages Ltd. If you wish to proceed with our recommendation, your adviser will then indicate the level of fee that will be charged. This fee is calculated based on your individual circumstances and the service provided by ourselves.

Our usual fee for a new mortgage transaction is £399

The fee is split into two parts:

  1. Engagement/Application Fee:  If after your initial consultation with your adviser, you wish to use our services, a fee of £250 is payable.  This is paid when the mortgage application is submitted.
  2. Completion Fee:  the balance of any fees due after the initial engagement/application fee, is payable on completion of the mortgage. This will usually be no more than £149

When and how our fees are paid

The Engagement/application Fee of £250 is due at the point you instruct us to carry out work on your behalf. This is collected electronically or if you prefer by bank transfer.

We will also receive a fee paid by the lender, upon completion of the mortgage along with our completion fee.

As a general guide, fees are charged for the following:

  • In relation to a purchase or remortgage of a residential or buy to let property
  • Further advances
  • Transfer of Equity on an existing mortgage
  • General mortgage administration

If more than one mortgage is arranged for a client at one time, a discounted fee will apply.
Fees are not normally charged if we are providing advice on products that are available with your present lender.

Any fees payable will be discussed and agreed by you prior to any transaction

Administration Service

We often find that our clients need advice and/or assistance with administration or other matters relating to their mortgage or finances.  We offer an additional service to meet these needs and often there may not be any charge at all. If we do charge a fee our minimum amount is typically £50.

Data Protection Statement

The information you have provided is subject to the Data Protection Act 1998. You consent to us or any company associated with us, processing, both manually and by electronic means, your personal data for the purposes of providing advice, administration and management.

“Processing” includes obtaining, recording or holding information or data, transferring it to other companies associated with us, product providers, the FCA or any other statutory, governmental or regulatory body for legitimate purposes including, where relevant, to solicitors and/or other debt collection agencies for debt collection purposes and carrying out operations on the information or data.

We may also contact you with details of any other similar products, promotions, or for related marketing purposes in which we think you may be interested.  We will not pass your details to a third party for marketing purposes.

You may be assured that we and any company associated with us will treat all personal data and sensitive personal data as confidential and will not process it other than for a legitimate purposes. Steps will be taken to ensure that the information is accurate, kept up to date and not kept for longer than is necessary. Measures will also be taken to safeguard against unauthorised or unlawful processing and accidental loss or destruction or damage to the data.

Under the Data Protection Act you have a right, on payment of a fee, currently £10, to obtain a copy of the personal information that we hold about you.  If you believe that any information held is incorrect or incomplete, you should contact our Data Protection Officer at our usual address. Any information that is found to be incorrect or incomplete will be amended promptly.

We are authorised and regulated by the Financial Conduct Authority (FCA).  Our Financial Services Register number is 445980.

Our permitted business is advising on and arranging non-investment insurance contracts and mortgages.

Are we covered by the Financial Services Compensation Scheme (FSCS)? 

We are covered by the FSCS.  You may be entitled to compensation from the scheme if we cannot meet our obligations.  This will depend on the type of business and the circumstances of the claim.


Insurance advising and arranging is covered for 90% of the claim, without any upper limit.


Mortgage advising and arranging is covered up to a maximum limit of £50,000.
